Effective date: September 30, 2026

These Terms and Conditions (“Terms”) govern your use of raisethebarperformance.com (the “Site”), purchases from our online store, and your relationship with Raise the Bar Performance (“we,” “us,” or “our”). By using the Site, making a purchase, or signing up for a membership, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. Memberships

Gym memberships are sold and managed through our membership platform, ManageMemberships. When you join, you will sign a membership agreement and a liability waiver. Those documents control your membership, including pricing, billing dates, cancellation, freezes, and facility rules. If anything in these Terms conflicts with your signed membership agreement or waiver, the signed agreement and waiver control.

  • Memberships renew automatically each billing period until cancelled according to your membership agreement.
  • You authorize us and our payment processors to charge your payment method on file for recurring dues and any other fees you agree to.
  • Keycards and access credentials are for the named member only. Sharing your access, letting others in, or propping doors may result in termination of your membership without refund.
  • Members under 18 must have a parent or guardian complete sign-up and sign the waiver.
  • We may suspend or terminate a membership for non-payment, unsafe conduct, damaging property, harassment, or violating facility rules.

2. Facility Use and Assumption of Risk

Exercise and use of gym equipment involve inherent risk of injury, including serious injury. The facility is open 24 hours a day and may be unstaffed at times. By using the facility, you accept these risks and agree to use equipment properly, within your abilities, and in line with posted rules. You should consult a physician before starting any exercise program. Your signed liability waiver sets out additional terms regarding assumption of risk and release of liability.

3. Personal Training

Personal training sessions are by appointment. Scheduling, cancellation, and payment terms for training are provided when you book. Training advice is for general fitness purposes and is not medical advice.

4. Online Store

  • Orders: placing an order is an offer to buy. We may refuse or cancel any order, for example if a product is unavailable or there is an error in pricing or description. If your payment was charged, we will refund it.
  • Pricing: prices are in U.S. dollars and may change without notice. Applicable sales tax and shipping charges are shown at checkout.
  • Product details: we try to show products accurately, but colors and sizing may vary slightly from images and descriptions.
  • Shipping: delivery times are estimates. Some items are made to order and may take longer to ship. Risk of loss passes to you when the item is delivered to the carrier.
  • Returns and refunds: returns are handled under our Refund and Returns Policy.
